Terms of UseYour access to and use of the BCPA Website psychologists.bc.ca ("Site") is subject to the following terms and conditions ("Terms Of Use"), including the Privacy Policy, and all applicable laws. Please read the Terms of Use prior to using the Site. Your access and use of the Site are conditional upon your agreement to these Terms of Use, which may be modified at any time without notice. Any such changes or additions will be reflected by an update of this posting. Please check these Terms of Use periodically for changes. Your use of the Site following the posting of any such changes will mean you accept those changes. 1. OWNERSHIP AND USE RESTRICTIONS This site and the software that runs it are owned and operated by psycorps.com Inc. Psycorps.com Inc. and its respective affiliates, investors, directors, officers, employees and shareholders shall be collectively referred to herein as the "Operators." The content on the Site (including, but not limited to, video, audio, photos, text, images, logos ("Content")) are owned by or licensed to the BCPA. No Content may be reproduced, republished, uploaded, posted, transmitted, distributed, publicly displayed or otherwise used except as provided in these Terms of Use, without the express written permission of psycorps.com Inc. You may download Content only for your personal, noncommercial use, and only provided you retain all copyright and other proprietary notices contained therein. You may not, distribute, reproduce, republish, display, prepare derivative works based upon, modify, transmit, reuse, repost, or use any Content for public or commercial purposes on any other website or otherwise, without the written permission of the Operators. The BCPA name and logo are the property of the BCPA. The ContinuingWeb.com name and logo and the names, url and logos of psycorps.com and ContinuingWeb.com are the property of psycorps.com Inc. All other trademarks, logos and service marks appearing on the Site are trademarks of their respective owners. Nothing contained on the Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark without the express written permission of its owner. Operators neither warrant nor represent your use of Content. 2. REGISTRATION FOR USE OF CERTAIN FEATURES To access certain features of the Site, you may be required to register with the BCPA by providing certain information about yourself, including your name and e-mail address. In consideration of such access, you agree to: (a) provide true, accurate, current and complete information about yourself as requested. If you provide information that is untrue, inaccurate, not current or incomplete, or the BCPA has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, the BCPA has the right to suspend or terminate your password and refuse any and all current or future use of the Site. Please note that BCPA is a professional organization. Non-member status can be granted to individuals at the discretion of BCPA. However, full member status cannot be granted to those who are not registered with the regulatory body in your Province or State of residence. In British Columbia this would be the College of Psychologists of British Columbia. Not being a member in good standing of the regulatory body is sufficient reason for BCPA to deny or terminate full member status. You may select a password as part of the registration process. You are responsible for maintaining the confidentiality of the password, and are fully responsible for all activities that occur under it. 3. THE ONLINE CONTINUING EDUCATION FEATURE ("CE FEATURE") The Site provides an education feature that allows you to register for continuing education online ("CE"), supplied by individual professionals or other content providers ("Content Providers"). ALL ORDERS ARE SUBJECT TO AVAILABILITY. PSYCORPS.COM INC. EXPRESSLY DISCLAIMS ANY RESPONSIBILITY OR LIABILITY FOR ANY DAMAGE, LOSS OR INJURY ARISING OUT OF: THE ACTIVITIES OF ANY CONTENT PROVIDER, ANY LOSS OR INJURY RESULTING FROM YOUR ACCESS OR INABILITY TO ACCESS THE CE FEATURE OR ANY OTHER PART OF THE SITE, OR ANY LOSS OR INJURY ARISING OUT OF YOUR USE OF THE INFORMATION PROVIDED THROUGH THE CE FEATURE OR OTHER ASPECT OF THE SITE. B. Consumers: To view content on the Site, the consumers of the educational content and other information ("Consumers") must provide their name, address, telephone number, and e-mail address. Fees are paid by consumers to view and access certain content on the Site. These fees are payable in advance. Fees paid by consumers to psycorps.com Inc are not refundable. Psycorps.com Inc may in its sole discretion decline service to or terminate any account. Neither psycorps.com Inc., its Content Providers nor the Operators are responsible for and must not be held liable for any breaches in transaction security by any third party. B: Community Notice Board (Bulletin Board): While the administrators and moderators of the forum will attempt to remove or edit any generally objectionable material as quickly as possible, it is impossible to review every message. Therefore you (the user of the forum, "Forum User") acknowledge that all posts made to these forums express the views and opinions of the author and not the administrators, moderators or webmaster (except for posts by these people) and hence the latter will not be held liable. Community Notice Board (Bulletin Board) Users agree not to post any abusive, obscene, vulgar, slanderous, hateful, threatening, sexually-oriented or any other material that may violate any applicable laws. LINKS The following restrictions ("Linkage Restrictions") apply to all links to the Site. A. Sites may link to the BCPA Site without the express written permission of psycorps.com Inc., if such link does not imply that the BCPA endorses any product or the truth of any statement or claim. B. The posting or creation of any link to the Site signifies that you have read these Linkage Restrictions and agree to abide by their terms. 8. DISCLAIMER OF WARRANTIES AND DAMAGES; LIMITATION OF LIABILITY While the Operators use reasonable efforts to include accurate and up-to-date information in the Site, the Operators make no warranties or representations as to its accuracy and assume no liability or responsibility for any errors or omissions in Content. TERMINATION OF SERVICE The Operators may change, suspend or discontinue any aspect of the Site at any time with or without notice, including the availability of any Site feature, or Content. The Operators may also cancel your registration password, or impose limits on certain features and services or restrict your access to parts of the Site, or the entire Site, with or without notice, and without liability, at any time in the Operators' exclusive discretion, without prejudice to any legal or equitable remedies available to the Operators, for any reason or purpose, including, but not limited to, conduct that the Operators believe violates these Terms of Use or other policies or guidelines posted on the Site or conduct which the Operators believe is harmful to other customers, to the Operators' respective businesses, or to other information providers. Upon any termination of this agreement, you will immediately discontinue your use and access of the Site and destroy all Content. BCPA reserves the right to cancel or downgrade the membership of any member at its sole discretion. This may occur due to the withdrawal of the member's professional registration, for example. If a membership is canceled or downgraded for any reason by the member or BCPA, there shall be no refund of fees paid to the former member. 8. PRIVACY POLICY The BCPA does not sell, rent, or share personal information that Consumers and Community Notice Board Users provide to us, except that information required for sending certificates and billing, unless you specifically consent to make this information available to others. Certain permissions can be modified by using the Profile feature on the forum. By using the site, you are giving explicit permission to share personal information including your username and information specified in the Community Notice Board User profile. We use cookies to enable us to allow you access to secure functions without requiring you to sign in on each page. Psycorps.com and the BCPA may provide links to other companies' web sites. Psycorps.com and the BCPA are not responsible for the privacy or security practices of these other companies. Please consult the privacy policies of these other companies for more information. 9. SECURITY OF PERSONAL INFORMATION Psycorps.com Inc maintains the following controls to ensure the security of information on the BCPA Site:

MEMBERSHIP By renewing or starting a membership with BCPA, I agree to the following terms: I am a registrant of the College of Psychologists of BC (CPBC), or I am a retired registrant of the College of Psychologists of BC. If limitations are put on my practice, or my registration is suspended or cancelled by the College of Psychologists of BC, I agree to notify BCPA within five working days. (Referral Members) If there are any limitations, terms or conditions to my registration to practice psychology, I agree to modify my practice accordingly, and apply these limitations to all referrals received through BCPA. (Referral Members) I agree to review annually my referral settings online for accuracy of contact information, geographical areas of service, and areas of practice. I agree to review and adhere to the forum guidelines and understand that they can be found at www.psychologists.bc.ca under profile management after logging in. 11. AFFILIATION By renewing or starting an affiliation with BCPA, I agree to the following terms: I understand that Affiliate status with BCPA confers no capacity to refer to myself as a psychologist. (Retired Affiliates) I attest to have been registered in good standing with a provincial or state regulatory body previous to my retirement. (Academic Affiliates) I hold a doctorate degree in psychology and an academic appointment at an accredited university/college in British Columbia. (Student Affiliates) I attest that I am currently enrolled in a post-graduate Psychology program at an accredited university in British Columbia, Alberta, or Washington State. 12. MISCELLANEOUS Note: The Affiliate (student, retired, and community) category with BCPA cannot be used to indicate any professional recognition, registration or credentialing status within the field of Psycholgy and to do so is a violation of the Health Professions Act and could result in a complaint to the College of Psychologists of British Columbia. These Terms of Use constitute the entire agreement between you and psycorps.com, and supercede all prior and contemporaneous written or oral agreements, or communications with respect to the subject matter herein between you, the BCPA, and psycorps.com Inc.. The Operators in their sole discretion may amend these Terms of Use, and your use of the Site after such amendment is posted on the Site will constitute acceptance of it by you. The section headings in these Terms of Use are for convenience only and must not be given any legal import. If any provision of these Terms of Use is held by a court of competent jurisdiction to be unlawful, void, invalid or unenforceable, the remaining provisions shall remain in full force and effect. Any disputes arising out of this agreement shall be governed by the laws of Canada and the Province of British Columbia. |
