Introduction. This agreement (”Agreement“) between You and the BC Psychological Association (”BCPA“) consists of the BC Psychological Association’s Referral Service’s (the “the Service“) Terms of Use (”Terms“). “You“, “Reader”, or “User” means any entity identified by its e-mail, registration information, phone number, IP or MAC address. If You use this Service on behalf of your employer, organization or company, they shall also be bound by the terms of this Agreement.

All licensing, registration, regulation and disciplinary matters are handled by the College of Psychologists of BC (“CPBC”, “the College”). The College regulates Registered Psychologists and Registered Psychological Associates (“psychologist(s)”). BCPA is not the regulatory body for psychologists in BC.

PLEASE READ VERY CAREFULLY THESE TERMS OF USE BEFORE ACCESSING, COPYING INFORMATION FROM, REPRODUCING INFORMATION FROM, AND LINKING TO (COLLECTIVELY “USING”) THIS SERVICE. USING THIS SERVICE INDICATES THAT YOU ACCEPT THESE TERMS OF USE. IF YOU DO NOT ACCEPT THESE TERMS OF USE, PLEASE DO NOT USE THIS SERVICE.

Description of the Service. BCPA presents this Service as a free service to You. You can access this Service online or by phone during BCPA office hours. Please be advised that these Terms apply for this Service, whether You access it by phone or through the Internet. This Service only lists psychologists. This Service does not list psychiatrists, counselors, therapists or any other professionals not registered with the College. The Service is not a complete list of all psychologists registered to practice in British Columbia.

Inquiries and Complaints. Inquiries on disciplinary action by the College should be directed to the College in writing. BCPA does not retain or hold information about past or present disciplinary actions on its members. However, psychologists listed as part of this Service have agreed to comply with any limitations imposed on them by the College. If you have a complaint against a psychologist listed by this Service, you must follow the complaint procedures outlined by the College on this web page: http://www.collegeofpsychologists.bc.ca/coverview.php. If you have other questions regarding this Service, please contact BCPA in writing.

Privacy Policy. This Service complies with and follows the general BCPA Privacy Policy, accessible here. By using this Service, You accept the terms of the BCPA Privacy Policy. 

Nondiscrimination Policy. This Service will comply with all applicable provincial and federal laws and statutes regarding nondiscrimination. In accordance with Part I, Section 5 of the Canadian Human Rights Act, BCPA will not deny access to this Service to any individual, nor will BCPA differentiate adversely on a prohibited ground of discrimination in relation to any psychologist listed as part of this Service.

Changes to the Terms. BCPA reserves the right to change these Terms at any time. It is Your responsibility to make sure that you agree with the new Terms, whenever changes have been announced. Changes to the Terms will be effective 48 hours after the notice has been posted on the BCPA website. If You do not agree with the Terms, DO NOT USE THIS SERVICE.

No Guarantee. Psychologists are responsible for informing BCPA when there is a change to their practice information, such as address and phone number, as well as when there are limitations imposed on their practice by the College. Accuracy of the Service throughout the year depends upon psychologists notifying BCPA of changes to their practice information. BCPA makes no guarantee regarding the accuracy of the content of the Service.

In addition, BCPA cannot guarantee that the Service will be accessible at all times or during any down time (i) caused by outages to any public Internet backbones, networks or servers, (ii) caused by any failures of Your equipment, systems or local access services, (iii) for previously scheduled maintenance or (iv) relating to events beyond BCPA’s control such as strikes, riots, fires, floods, explosions, war, terrorism, governmental action, labor conditions, natural or man-made disasters, or interruptions in Internet service to an area where BCPA or Your servers are located.

No Warranty or Condition; Links. BCPA makes NO WARRANTY OF ANY KIND. To the extent links and external content are based on or displayed in connection with the Service, BCPA SHALL NOT HAVE ANY LIABILITY IN CONNECTION WITH THE DISPLAY OF SUCH LINKS AND SEARCH RESULTS, whether this external content is breaking the law in this or other jurisdictions. YOU AGREE TO USE THE SERVICE AT YOUR OWN RISK, and that You will not consider the Service to be a suitable substitute for professional advice.

Limitations of Liability. IN NO EVENT SHALL BCPA BE LIABLE UNDER THIS AGREEMENT FOR ANY DAMAGES OR LOSSES UNDER THIS AGREEMENT. Each party acknowledges that the other party has entered into this Agreement relying on the limitations of liability stated herein and that those limitations are an essential part of the Agreement. Without limiting the foregoing, BCPA shall not have any liability for any failure or delay resulting from any condition beyond the reasonable control of BCPA, including but not limited to governmental action, labor conditions, power failures, natural or man-made disasters.

Obligation to Indemnify. You agree to indemnify, defend and hold BCPA, its employees, directors, and applicable third parties (collectively “Indemnified Person(s)“) harmless from and against any and all third party claims, liability, loss, and expense (including damage awards, settlement amounts, and reasonable legal fees, brought against any Indemnified Person(s), arising out of, related to or which may arise from Your use of the Service and/or Your breach of any term of this Agreement. In Québec, this will include judicial and extra-judicial costs and fees; elsewhere in Canada, legal fees on a solicitor and its own client basis.

Applicable Laws; Venue. BCPA operates the Service from British Columbia, Canada, and makes no representations that materials in the Service are appropriate or available for use in other locations. Any claim related to the use of the Service or to Service materials and contents shall be governed by the laws of the Province of British Columbia. Any action related to the access, use, content, or existence of this Service shall be filed only in the appropriate court located within British Columbia. The use of this Service constitutes Your express permission and consent to the jurisdiction of the provincial and/or federal courts of the Province of British Columbia for purposes of such actions.
